Federal Court Rules Tax-Exempt Independent Schools Must Comply with Title IX

A federal court in Maryland just issued an opinion extending Title IX to private and independent schools. While Title IX previously only applied to schools receiving federal funds, the court reasoned that enjoying tax-exempt status equates to receiving federal funds. The U.S. District Court issued a similar ruling for the Central District of California. (See Herrera v. Valley Christian Academy.) Such rulings, if upheld, will extend Title IX obligations to a sector of the education community that will have to play catch up, and quickly, to comply with the law.
